The One Big Beautiful Bill Act (OBBBA), enacted on July 4, 2025, raised several federal Form 1099-MISC thresholds from $600 to $2,000 for the 2026 tax year, including rents, prizes and awards, other income, medical and health care payments, and crop insurance proceed. Categories like royalties ($10), attorney proceeds ($600), and fish purchases ($600) remain unchanged.
When you miss a deadline or submit an inaccurate return while balancing multiple deadlines and different forms to file, the IRS will send you a notice of a 1099 late filing penalty (or penalties) detailing what you owe to correct the situation. Once you notice that you missed filing a 1099-MISC, you should file it immediately.
Form 1099-MISC is among the most important information returns. Businesses file it with the IRS (Internal Revenue Service) for specified kinds of non-employee payments. The service provider can use it to pay necessary taxes and follow relevant laws.
Before filing, make sure to confirm that Form 1099-MISC is the correct form. Use Form 1099-MISC only for payments like rents, royalties, prizes and awards, medical and health care payments, crop insurance proceeds, fishing boat proceeds, and gross proceeds paid to attorneys.
Payments for services performed by nonemployees, such as independent contractors or freelancers, do not belong on Form 1099-MISC, they belong on Form 1099-NEC instead. Attorney payments can also be split between the two forms: fees for legal services go on Form 1099-NEC, while gross settlement proceeds paid to an attorney go on Form 1099-MISC.
IRS form 1099-MISC is used to report miscellaneous payments made in the course of business or trade in a tax year. Business taxpayers use this form to report payments such as rent, prizes, payments to an attorney, medical and health care payments, and more. As a result, the payer reports a range of payments and tax withholding from the contractor/recipient.

Start by collecting all the required information, including the recipient’s name, address, TIN, and payment amount. Fill out the form, report the payment in the correct Form 1099-MISC box, and file it as soon as possible.
