Partnerships and multi-member LLCs taxed as partnerships can use Form 7004 to get more time to file Form 1065 to report the partnership’s financial and tax information to the IRS.
Partnerships report their income, expenses, deductions, credits, and other tax information to the IRS using Form 1065. These items generally pass through to the partners, with Schedule K summarizing the totals and Schedule K-1 reporting each partner’s share.
There is a deadline for filing Form 1065- 15th day of the 3rd month after the end of the partnership’s tax year, or March 15 for partnerships following the calendar year. If more time is needed, the IRS offers the option of filing an extension.
The extension request can be sent to the IRS using Form 7004. When filing an extension for Form 1065, use Form 7004 code 09. A completed Form 7004 filed and submitted on or before the applicable filing deadline gets you six additional months to file.
The IRS generally does not send any approval notice. The extension is automatic. They will notify the filer only if the extension is disallowed. It does not extend the time to pay.
A partnership extension is filed by Form 1065 filers, such as partnerships and LLCs classified as a partnership.
A domestic LLC with at least two members is generally classified as a partnership if it does not elect another federal tax classification.
Every domestic partnership has to file Form 1065 unless it had no income and no deductible or credit-related expenditures during the year.
State-law entity labels do not by themselves determine if a federal return is required. A multi-member LLC may be treated as a partnership for federal tax purposes, but it can also elect corporate tax treatment. That is why you should confirm the entity’s federal tax classification before using Form 7004 code 09.
If the entity is an LLC, made a tax-classification election, or changed classification during the year, confirm the federal return before filing Form 7004 with code 09.
A domestic partnership following the fiscal calendar has to file Form 1065 by the 15th day of the third month after the end of its tax year. For calendar-year partnerships, the regular due date is generally March 15.
Form 7004 follows the Form 1065 filing deadline. The extension has to be filed on or before the applicable deadline to automatically receive an additional six months to file.
Apply the weekend/legal-holiday rule and any applicable IRS disaster relief when determining the actual filing date.
A partnership that uses the Regulations section 1.6081-5 special rule for a qualifying partnership outside the U.S. and Puerto Rico should attach the required statement to its Form 1065 stating that it qualifies.
If there are any short-year and accounting-period-change situations, follow the current Form 1065, Form 7004, and IRS e-file rules.
Submit the Form 7004 request by the partnership's applicable regular due date.
To get an automatic filing extension for Form 1065, you need to prepare the partnership identity, return code, tax period, and required Part II amounts before filing.
Before submitting the 1065 extension form, review the key points such as legal name, EIN, code 09, tax-year dates, short-year information when relevant, and Part II amounts. The current Form 7004 does not require a signature.
Before filing an extension, confirm that the entity is a Form 1065 filer for the tax year being extended. Verify the partnership name, EIN, address, and filing period, and make sure to select Form 7004 code 09 in Part 1 line 1.
Enter the partnership's details, then complete the required Form 7004 Part II information. Part II requires you to report the tentative tax, payments and refundable credits, and any balance due. It also asks for the tax year covered by the extension and, when applicable, the reason for a short tax year.
Review the information and filing details before submitting Form 7004 to the IRS using Tax1099's guided filing workflow. After submission, track the filing status and keep the filing record for your records.
Note: Confirm the current IRS e-file limitations. Form 7004 can generally be e-filed through the IRS Modernized e-File system. However, the IRS does not allow electronic filing in certain situations, including name-change applications, certain accounting periods, an early filed return, or another special filing condition.
A Form 1065 extension form gives partnerships an additional six months to file after the filing deadline has passed.
Form 7004 extends the filing time, it does not extend the time to pay tax due. Only qualifying partnerships covered by Regulations section 1.6081-5 have a separate special rule for their initial filing-and-payment period.
A timely extension filing can prevent partnerships from having to pay Form 1065 late-filing penalties. The IRS penalizes partnerships that fail to file their returns and extensions on time.
For example, 10 partners and a 1-month delay can result in a $2,550 penalty.
Tax1099 provides a secure electronic extension filing for eligible partnerships and multi-member LLCs taxed as partnerships.

A partnership that files Form 1065 can use Form 7004 to request additional filing time with Form 7004. The current Form 7004 code a partnership uses is code 09.
Form 7004 is generally due by the regular Form 1065 filing deadline. Filing Form 7004 on or before the deadline provides an automatic 6-month filing extension.
The Schedule K-1 furnishing date generally follows the partnership's extended Form 1065 due date. The partnership extension does not extend an individual partner's Form 1040.
No. Filing a partnership extension extends the filing time for Form 1065. It does not extend the time to pay tax due. Form 8804 is a separate return. A partnership that needs to extend both Form 1065 and Form 8804 has to file separate extensions for the returns.
File Form 7004 with Tax1099 to request additional time to file partnership Form 1065, featuring automated error checks, secure e-filing, and status tracking.
