Are certain businesses exempt from filing 1099-NEC? How does this new form affect the default 1099-MISC filing?<\/p>\r\n\r\n\r\n\r\n\r\n\r\n\r\n\r\n<h2 class=\"wp-block-heading\">What\u2019s The Difference Between Form 1099-MISC and Form 1099-NEC?<\/h2>\r\n\r\n\r\n\r\n<p>First things first. Let\u2019s understand the fundamental <a href=\"https:\/\/www.tax1099.com\/blog\/difference-between-form-1099-misc-and-form-1099-nec\/\">difference between 1099-MISC and 1099-NEC<\/a><\/p>\r\n\r\n\r\n\r\n<h3 class=\"wp-block-heading\">Form 1099-MISC<\/h3>\r\n\r\n\r\n\r\n<p>A <a href=\"https:\/\/www.tax1099.com\/1099-forms\/efile-1099-misc-form\">1099-MISC form<\/a> is used to report the miscellaneous incomes that your payees have received from your business. For example, if your business has paid rent, made medical and health care payments, or paid money to a legal attorney for their services, then you have to report such payments in the 1099-MISC form.<\/p>\r\n\r\n\r\n\r\n\r\n\r\n<h3 class=\"wp-block-heading\">Form 1099-NEC<\/h3>\r\n\r\n\r\n\r\n<p>A 1099-NEC form is used to report the payments your business has made to independent contractors or vendors for their services. For example, if you paid a designer for designing your business logo, then such payments are considered to be \u201cnonemployee compensations\u201d.<\/p>\r\n\r\n\r\n\r\n<p>As the name suggests, a <a href=\"https:\/\/www.tax1099.com\/1099-forms\/efile-form-1099-nec\">1099-NEC form<\/a> deals exclusively with \u2018nonemployee compensation\u2019 (NEC) that a business has made through the course of business or trade in the tax year.<\/p>\r\n\r\n\r\n\r\n\r\n\r\n\r\n\r\n<h2 class=\"wp-block-heading\">Which Form Should I File For The Tax Year 2020-2021?<\/h2>\r\n\r\n\r\n\r\n<p>If you are a business taxpayer, then you are required to file Form 1099-MISC and Form 1099-NEC for the tax year 2020-2021 to the IRS (regardless of your organization being a for-profit or nonprofit entity).<\/p>\r\n\r\n\r\n\r\n\r\n\r\n<p>You do not need to file Form 1099-NEC if you have not made any payments to independent contractors.<\/p>\r\n\r\n\r\n\r\n<p>You do not need to file Form 1099-MISC if you have not made any payments in the course of your business.<\/p>\r\n\r\n\r\n\r\n<p>However, it is close to impossible for a business to function without making payments for one thing or another. So, it is likely that you must have made <em>some <\/em>form of payment to someone and you need to check if those payments fall within the guidelines of the IRS.<\/p>\r\n\r\n\r\n\r\n<h3 class=\"wp-block-heading\">Bonus Tip:<\/h3>\r\n\r\n\r\n\r\n<p>It\u2019s always safe to be in the good books of the IRS and comply with the IRS. Avoid penalties, prison time, and other unpleasant experiences by filing your forms to the IRS before the 1099-MISC or <a href=\"https:\/\/www.tax1099.com\/blog\/1099-nec-filing-deadline-2026\/\">1099-NEC due date<\/a>. At the same time, do not be in a rush to file your forms just for the sake of filing. Make sure that your forms show accurate information.<\/p>\r\n\r\n\r\n\r\n\r\n\r\n<h2 class=\"wp-block-heading\">When Should I File Forms 1099-MISC and 1099-NEC?<\/h2>\r\n\r\n\r\n\r\n<p>The PATH Act, P.L. 114-113, Div.
